What are registered trademarks?

Any sign which can be represented graphically, and which is capable of distinguishing the goods or services of one undertaking from another. Examples includes: - a word, phrase, logo, 3 dimensional object, smell or sound.

Requirements for validity

  • Valid for ten years, but can be renewed for a fee and therefore can last forever.
  • Can be revoked if not used for 5 years.
  • ® denotes a legally registered mark in the appropriate country
  • ™ or * shows that a mark is your trademark, but is possibly not registered A registered mark may only be used by the registered owner or licensee.

Why have a trademark?

  • In a global market, a symbol is much more valuable than translated words
  • Is the legal basis for the development of brand identity.
  • Can help create a strong competitive advantage, if used and protected properly.
  • Provides legal redress against counterfeiters.
